Complaint Procedures

All complaints regarding the police department or one of its employees will be investigated. The Investigation may be either formal or informal depending on the type and severity of the complaint. Minor infractions of policies, procedures or other rules may be handled at the supervisory level through counseling, training or admonishment.

Allegations of crimes or serious rule infractions will be documented and handled more formally through an investigator. If sustained, these allegations could result in the member being suspended, demoted, or terminated.

Depending on the circumstances and information that you provide, you may be contacted at a later date for additional information by an investigator or supervisor.

If the complainant is unwilling to sign this form, the complaint will be handled in an informal manner and investigated by a supervisor.

Generally, supervisors or investigators will have 30 days to conclude an investigation. That time may be extended by command staff because of extenuating circumstances. If necessary, you may be contacted sometime during the investigation to be given and update on the investigation’s progress.

Any employee involved with the Investigation will be informed of the substance of the complaint unless doing so would prejudice the Investigation.

Upon completion of the investigation and determination of the appropriate action, you will be notified of the results of the investigation. If the investigation was handled by a supervisor, you may be contacted directly by that supervisor. If the investigation was handled formally, the investigator and or successive levels of command will recommend to the Chief of Police one of several alternative findings. These alternative findings include:

– Sustained
– Not Sustained
– Unfounded
– Policy Failure

The Chief of Police for the Mooresville Metropolitan Police Department will, after the review of the Investigation, make the final determination and then direct the action, if any is necessary, to be taken.
